New FTC Rules

I haven’t read much about the new FTC rules that became law yesterday, but I thought I’d pass on a couple of good links to other blog posts talking about the subject. I’ll update this post with more links as I run across them and comment when I know more about how to deal with the rules.

    The new rules only apply to the big fish. People who are making ridiculous claims and bogus testimonies need to watch out!

    It should be interesting to see what happens in the coming months. Many sales pages, television and internet advertisements, and other marketing media don’t comply with the new rules. Some of the companies using non-compliant ads are either going to have to changes things up or bow out.

    This is really world shattering news. A lot more work would have to be done for all marketers from now on. Although from the consumers point of view, they have much more protection from now on. This is from the view that the consumers now have more accurate information regarding about the performance of the product.

    Its great to see recycling becoming such a major part of our everyday lives. More and more large companies are now thinking about how they are using their resources. A skip hire company near me now offer recycling to reduce your costs as it requires much less land fill tax, good news!!

    Under the FTC’s new rules, if an advertiser puts up a sign it can now legally bribe bloggers and demand coverage within hours, and any liability for the remaining non-disclosure is purely the problem of the blogger. With advertisers now insulated, I’m going to bet that the FTC will not expend too many resources chasing every single blogger in the country to enforce this.

    My only problem is that the FTC is singling bloggers out. It’s a total double standard. Traditional media is way more guilty of getting special treatment from companies, gifts, trips, dinners, etc… and they carry more influence (for now) than bloggers do. I find the penalty heavy handed, and insulting that they consider bloggers to be unprofessional, when in fact the bloggers who carry any influence at all are indeed professionals.

    The FTC introduced new rules requiring that bloggers disclose gifts they receive from advertisers. This is good news for those of us who do use ethical marketing practices and play by the rules. Iso it is batter rules

    As to the FTC regulating affiliate marketing, will this extend to multi-level marketing as well? Sounds like honesty is the best policy. I understand that each “vendor” should take the responsibility for validating the a product and be transparent about their role as a salesperson. Does that sound accurate?

    The real question for the FTC is a matter of enforcement. Are they doing this to remain relevant? Keep the rules in check for a rapidly changing market? Enforcement will be difficult, but I have no doubt that some of the more blatant offenders are probably already on the FTC’s watchlist and will be the first to feel the wrath of these new rules in order to serve notice that they are paying attention.

    It’s all about transparency and honesty. If you say you’re paid to endorse a product, you’re okay. If you are clear about ads being, well, advertisements, you’re clear. If you express your own opinion and don’t make claims promising results you can’t support, you’re probably okay. I don’t see this as big brother, more like big momma making sure I don’t get cheated or fooled … or keeping it real.

    I’m all for transparency and honesty. Since my practices are already ethical, I’ll simply need to add some clarification language to my resource page (product endorsements for small businesses; some affiliate links), and review my testimonials page for compliance of “typical results a consumer can expect to achieve”.

    Bloggers especially stand to gain. Being transparent is never a bad thing, and I think the disclosure will make bloggers more trustworthy overall. After all, it’s okay to write paid reviews – but readers deserve to know the motivations of why a certain product or service is being featured (sponsored or not).

    To state the obvious: you should always be completely honest in your reviews, and of course never say (or blog) anything that you can’t back up or stand behind. My issue with these potential regulations is in the FTC judging whether my opinion is offensive – according to their strict guidelines – or whether my results are typical or not.

    Those FTC rules are a good idea as when we are searching for topics in Google, we don’t want to be presented with topics that are of no use. I agree with these actions.
